MUI Fatwa on DBS (multi level marketing)



PT. Future Ambassadors International is seeking forgiveness as big because there are obstacles in the Halal MUI Fatwa for DBS business. Although, according to KH. Maftuh Holil, Chairman of the Council of Fatwa MUI, DBS is a business that is Halal MUI but until now has not issued a fatwa for Halal terkhusus as a company have their personal votes.

MUI Fatwa Commission conference in Bandung on MLM Business of Law, after



Considering:

a. That the more variety of products that a company diperjual sale to the public with the MLM system.

b. That therefore, MUI Bandung look to set a fatwa on legal issues in question.



Given:

a. Questions from people about the legal status of MLM business.

b. Opinions and suggestions of the Ulama conference participants.



Given:

1. The problem description as follows:

The simple, in that market a product from a company there are two kinds of ways:

A. Which is a common effect, called the conventional way.

That is take a product to consumers through after at least 4 (four) the following: from factory to distributor, then to the agent, and then to the wholesaler, then to the retailer / store and new to the consumer. When the factory price of Rp. 100,000 so until after the consumer can be Rp. 200,000 or more, to absorb as many costs, such as production costs, promotional costs and other costs.

B. MLM (Multy Level Marketing) or tiered marketing system (Network Marketing)

In this system, a consumer should be able to recruit consumers (network) underneath called Frontline (network / feet first) or upline and downline (network / foot second and so on) and he will receive benefits (Percentage) of each of these spending downline. The more network (downline) then the larger the benefits will be received by it. When able to reach a certain point in accordance the requirements, it will occupy a position and will receive a bonus that has been determined. This cut off above the stages, ie, from the factory directly to the consumer at a time can be a distributor. About the price, but only as excess over the price of the factory will be profitable distributor.



In fact, there are three kinds of forms that are associated with the MLM business:

a. MLM that does not sell products, usually called the money game (game money). MLM company this sometimes does not lead to a reasonable price (above the market price) and sometimes blurred somewhere to go, so many who have never received a bonus and promised that the network is down again can not develop the network.



c. Companies that market products with tiered system Sales (Network Marketing).

Is a company that sells products with a tiered system, so that each customer in the company is also a distributor. Which will benefit by the amount of network and omzet achieved in accordance with the approved marketing system since the beginning. With the price of the product is quite reasonable.



2. Mu'amalat Islamic principles:

Islamic law is the law-oriented kemaslahatan of magnitude for human life, both individual and community (mashalih al-'ammah). Orientation is the fundamental consideration for any mu'amalat that happens, both for existing, and for a new show that direspon by many people such as Network Marketing / MLM.



Mu'amalat for Islamic halal is built on the following principles:

1. Tabadul al-manafi '(exchange of goods valued manfa'at);

2. 'An taradlin (willingness of both parties who deal with no coercion);

3. 'Adamu al-gharar (not a risky venture that does not clear / transparent),

4. 'Adamu Maysyir (there is no chance such as gambling or ba' i al-yi hashat: send goods with the gravel and hit a shot that had to be purchased, such as buying land or area of gravel pitch with the price agreed, and the ba 'i al-lams yi: goods that are purchased need to be touched),

5. 'Adamu usury (the system does not have interest-bearing),

6. 'Adamu al-gasysy (no trickery), such as al-tathfif (cheating in weighing or menakar),

7. 'Adamu al-najasy (do not bid najasy the goods only to influence other potential buyers so that a higher price),

8. Ta 'awun' ala al-birr wa al-godly (helping in the good and godly),

9. Musyarakah (cooperation).



3. Principle (principium) sale and purchase

a. Ba 'i (the seller);

b. Jupiter (the buyer);

Terms of the seller and the buyer must shah is a (feasible) to do a transaction.

c. Mabi '(goods diperjual the sale).

The requirement that the goods diperjual sale must have manfa'atnya, sacred objects (not excretion) and the lawful use or consumption and / use.



4. Islam allows create conditions / agreement in any transaction that is agreed by all parties, as in the MLM business, not to menghalalkan during the forbidden, or vice versa.



5. Evidence-proof as follows:



A. Allah swt says.:

يآيها الذين آمنوا لا تأكلوا أموالكم بينكم بالباطل إلا أن تكون تجارة عن تراض منكم.

وتعاونوا على البر والتقوى ولا تعاونوا على الإثم والعدوان.

ويل للمطففين. الذين إذا اكتالوا على الناس يستوفون. وإذا كالوهم أو وزنوهم يخسرون.

"Woe to those who are cheating, (is) the people who receive a measure of when the other people they have met, and when they menakar or weigh for others, they reduce." QS al-Muthaffifiin: 1-3.

إنما المؤمنون إخوة فأصلحوا بين أخويكم, واتقوا الله لعلكم ترحمون.

"Those who believe it is relative, then rukunlah among brothers. Bertaqwalah And to Alllah that you find mercy." Q.S. Al-Hujurat: 10.

كى لايكون دولة بين الأغنياء منكم.

B. Word of the Prophet Muhammad saw.:

نهى النبي صلى الله عليه وسلم عن بيع الحصاة وعن بيع الغرر.

"He said. Prohibits the sale-purchase with a throw pebbles." HR. Five people perowi hadith except Bukhary from Abu Hurairah Ra.

إن رسول الله صلى الله عليه وسلم قال: من حمل علينا السلاح فليس منا, ومن غشنا فليس منا.

عن جابر ر. ع. أنه سمع رسول الله صلى الله عليه وسلم يقول عام الفتح وهو بمكة: إن الله ورسوله حرم بيع الخمر والميتة والخنزير والأصنام. فقيل يا رسول الله: أرأيت شحوم الميتة فإنه يطلى بها السفن ويدهن بها الجلود ويستصبح بها الناس? فقال: لا, هو حرام. ثم قال رسول الله صلى الله عليه وسلم عند ذلك: قاتل الله اليهود إن الله عز وجل لما حرم عليهم شحومها أجملوه ثم باعوه فأكلوا ثمنه.

وفى رواية له, نهى رسول الله صلى الله عليه وسلم عن ثمن الكلب ومهر البغي وحلوان الكاهن. وعنه قال: نهى النبي صلى الله عليه وسلم عن ثمن الكلب والسنور.

المسلمون على شروطهم. رواه البخارى.

C. Fiqh rule:

لا ضرر ولا ضرار.

"No memudaratkan and not dimudaratkan (not mutually memudaratakan)."

الحكم المعلق بشرط لا يصح إلا بوجود شرطه.

"Law is associated with a condition / agreement does not then shah unless these requirements already exists."


Decide

By constantly seeking and ridla taufiq and guidance of Allah swt.



Setting:



First:

MLM is the first MLM that does not sell a product called the money game (game money) law forbidden, because the real form of fraud.



Second:

MLM company that is the second MLM companies that sell products other people may be legal, only the prospective customer (prospective members are MLM) should be careful because the price of goods does not become reasonable, and sometimes can go bankrupt.

Third:

MLM is a third of the companies that market products with a tiered selling system on the ruling shah / halal. The existence of the promised bonus, reconcile with ju'alah.



To note:

1. For prospective members, should understand the procedures and regulations in MLM;

2. For anyone should not buy goods that are not necessary because including israf prohibited by Islam.
